Landlords must fulfil a number of legal obligations to ensure compliance as well as the safety and well-being of their tenants.
Here property expert Julie Ford looks at the key obligations for landlords.
The first and most important is Permission to let
Do you have the correct mortgage product or has your lender given you permission to rent out the property?
Secondly, does your superior lease allow you to rent out the property? Are their any restrictions to this?
Safety Standards Compliance:
Installation of a smoke alarm on each floor
and carbon monoxide detectors in rooms with
solid fuel burning appliances.
Electrical safety inspection ( EICR) this are required every 5 years and must test the full electrics of the property.
Annual Gas safety checks by a qualified Gas Safe Engineer for gas appliances.
Adherence to fire safety standards for furniture and fabrics.
Maintenance of a safe water supply to prevent Legionella risks.
Energy Performance Certificate (EPC):Every tenanted property must have an EPC rated E or above, unless exempted.
Right to Rent Checks: - Landlords in England must conduct Right to Rent checks for new tenants to verify legal residency.
Penalties for Non-compliance:
Failure to comply with immigration requirements can lead to unlimited fines and up to 5 years in prison.
Landlord Information:
Landlords must provide tenants with their full name and address or letting agent details, along with the Government's How to Rent guide.
Deposit Protection:
Tenancy deposits must be protected with a UK government-approved scheme, with penalties of up to 3x deposit for non-compliance.
Repairs Responsibility:
Landlords are responsible for most exterior and structural repairs, including roof, walls, and equipment maintenance.
Property Access:
Landlords must give reasonable notice and arrange suitable times for property access, ensuring minimal interference with tenants.
Tenant do have the right to refuse access.
